Filing Fees

PLEASE NOTE: In Madison County Chancery $72.50 must be added to the following listed clerks' fees for litigation tax upon the filing of a new action.
Standard filing fees must be paid when the case is filed. Filing by pauper's oath is allowed upon application IF ordered by the Chancellor. Rules regarding payment of court costs with respect to orders of protection have not changed.

Fees other than filing fees are required at the time the service is requested, except for continuances which are taxed at the discretion of the Chancellor and collected at the end of the case.

Filing fees are broken down by category as follows: 

Category One Cases: $227
This category includes actions for enforcement of contracts or breach of contract actions; injunctions, torts; personal injury; property damages cases; malpractice suits; wrongful death suits; employment discrimination suits; civil rights suits; tax disputes; special remedies; property disputes; cases and actions not otherwise designated.

Category Two Cases: $152
This category includes appeals to circuit and chancery from general sessions, city courts, juvenile, probate, administrative hearings, writs of cert from lower courts or administrative hearings; transfers from foreign counties; writs of mandamus; workers compensation cases; condemnation/inverse condemnation; quo warranto actions.

Category Three Cases: $102
Adoptions, legitimation, paternity cases, restoration of citizenship, termination of parental rights, other domestic relations matters not otherwise designated, name changes, minor settlements, enforcement of foreign judgments, civil expungements where authorized by law, and orders of protection.

IF A CASE INVOLVES TEN OR MORE DEFENDANTS, REASONABLE COSTS MAY BE ADDED IN EXCESS OF THE STATUTORY AMOUNTS LISTED AS NORMAL AND ROUTINE FILING FEES. A COST BOND MAY ALSO BE REQUIRED IN THESE CASES.

The following fees apply uniformly in all courts and may be charged in addition to the general filing fee in a case or proceeding: 

Post Judgment Fees:
A clerks' fee of $25 will be charged per occurrence each time one of the following services is requested. (Service fees are not included in the $25.)

Issuance of Subpoenas: $6.00

Continuances: $7.00

Copies: $ .50/page plus $5.00 for certification

Preparing a record on appeal from a court of record to an appellate court: $300

Commission on invested funds: 5% Selling real or personal property under decree of court and receiving, collecting and paying out proceeds: Up to 10% Receiving funds on confirmation of private sales: $40
